Edson Fachin, the president of the Supreme Court, has sent a letter to the director-general of the Federal Police, Andrei Rodrigues, to discuss investigations involving ministers. The meeting is expected to take place on October 13, but it may be advanced.

Fachin clarified that any reports or information from the investigations that involve ministers should be sent only to the presidency, not to other offices. He emphasized that following legal rules guarantees not only the rights of the investigated but also the legitimacy and effectiveness of the investigation.

The Federal Police has been at the center of the Supreme Court crisis, following a report that led to demands to investigate Alexandre de Moraes for his alleged relationship with ex-banqueiro Daniel Vorcaro, who is preso preventivamente.

Another intelligence report from the Federal Police pointed to alleged abuse of authority and political favoritism by André Mendonça in the Banco Master and INSS investigations. A series of leaks involving ministers and politicians has also been attributed to sectors of the Federal Police.

Fachin reiterated that he has faith in the police and the Public Ministry as permanent state institutions that will perform their duties with independence and responsibility. He emphasized the importance of rigorously investigating any relevant facts without exception.

The purpose of centralizing information, according to Fachin, is to ensure that all facts are properly clarified without any exceptions. He also stressed the need for strict observance of due process, the competence of investigative bodies, and the guarantees of jurisdiction.

Fachin says that there is an “inequívoco interesse institucional” in having any relevant fact rigorously investigated, without exception. The president of the Supreme Court also says that there must be “observância rigorosa” of the due process, the competence of the investigative organs, the persecution penalty, and the guarantees of the jurisdiction.
